Dunwoody is a city located in metro Atlanta, in northern DeKalb County, Georgia, United States. Formerly a census-designated place (CDP), it became incorporated as a city on December 1, 2008. As of the 2000 Census, the CDP had a total population of 32,808. A recent estimate placed the city's population at 39,583. It is the third wealthiest city in Georgia and the hometown of American Idol host Ryan Seacrest.


Dunwoody Village
Also known as downtown Dunwoody, and is the location of the iconic Dunwoody Farmhouse. This area was typically thought of when one mentioned Dunwoody, previous to incorporation. This happens to be the place where the "Williamsburg-style" architecture originated with the construction of Dunwoody Village shopping center in the 1970s. Since then, all other construction followed suit in this area, and an architectural overlay district has been set up since. The neighborhoods of Wyntercreek, Wynterhall, Verdon Forest, Fairfield, Redfield, Withmere, and Mill Glen are on the north side of the district and are newer subdivisions. The south side going toward Georgetown includes older Springfield, Holly Oak, and Cambridge. It also includes the numerous subdivisions along Womack and Vermack roads. The Dunwoody Library, Dunwoody High School, Dunwoody Nature Center, and the Fire Station are also considered part of downtown.
 
Perimeter Center
Perimeter Center is the major edge city that has formed around Perimeter Mall. The mall was developed in 1971, with all the office, residential, and commercial development occurring since then. It is a major job center, employing thousands of people each day. It also could be considered the "business district" of Dunwoody. Legal Tip: Deadlines and Issues for the 2nd Quarter


April 1st marks the beginning of the 2nd quarter of the year, and there are some deadlines and issues to consider in selling, buying, or

managing real estate.

 

1.  Income tax:  filing deadline is April 15, 2010 (for 2009 income) 

*Tax returns are required for almost all mortgage applications and short sale applications, especially if the closing will take place after April 15th.

 

 2.  First Time Homebuyer Credit (up to $8,000) and Move-Up Homebuyer Credit (up to $6,500) 

    * Contract must be signed by April 30, 2010

    * Closing must take place by June 30, 2010

 

3.  FHA upfront MIP increases from 1.75% to 2.25% for any FHA case numbers issued starting on April 5, 2010  

*Make sure that your buyer?s case number has been issued

   for an FHA loan application, or make sure that

   the buyer gets a revised Good Faith Estimate.

 

4.   Home Affordable Foreclosure Alternatives program goes into effect on April 5, 2010  

*This program gives incentives to lenders to expedite and streamline the short sale process.

Price it Right - Pricing and Staging Stats


Sellers who listed their home at the price originally recommended by their agent sold it:

• 38 days faster
• For 2.25% higher
• With 1 less price reduction

Compared to sellers who did not take their agent's recommendation.

 

Staging Stats

Compared to homes that were not staged, staged homes had:

• more showings
• a higher list-to-sell percentage

Other notable stats found include:

• Only 1 in 3 sellers staged their home, even with all the commonly accepted advantages of staging.
• Staging typically took between 2 - 6 hours to complete.
• Including the cost of a staging professional and items purchased or rented, staging cost an average of $523.

Although it has advantages at all price points, staging was also found to be particularly important for homes priced over $600,000.

First Time Home Buyers Study

Earlier this year, KW Research conducted a study of first time Home Buyers and here?s a few of the findings:


· The median age was 28, significantly down from where it was four years ago at 32.
· Location or Neighborhood was the No. 1 ?must-have? for 36% of buyers.
· 25% saw 5 or less homes before writing an offer, the average buyer saw 10 homes.
· 2 out of 5 first-time buyers purchased a distressed property.
· 2 out of 3 sellers paid at least part of the buyer?s closing costs.
· 1 in 4 had help from their family for the down payment.

The Income Tax Effect from a Short Sale or Foreclosure:

IRS Form 1099-C

 

 

Who is Affected?

Any property owner who was personally liable on a real estate loan that was foreclosed or partially paid off in a short sale.

 

When Will the 1099-C Be Issued?

Unless the lender is pursuing a deficiency judgment, the 1099-C must be issued by January 31st.  If the lender sends the 1099-C, the lender has written off the loss as a bad debt. 

 

What is IRS Form 1099-C?

 This form represents ordinary income (not capital gain) for the ?Cancellation of Debt? of the seller/owner.  The amount must be included in income on the seller?s income tax return.

 

How is the Amount on the 1099-C Determined?

Short Sale: the difference between the full payoff and the short sale payoff

Foreclosure:  the difference between the full payoff and the fair market value, based on an appraisal at the time of foreclosure.

 

Does the Seller Have Any Offsets Against This Income? 

Sale of principal residence (IRS FORM 982): subject to some limitations on amount and qualifying debt.

Capital loss: seller?s capital loss (for investment property) can be used to offset capital gains and a small portion of ordinary income.

Insolvency: income can be offset to the extent that debts exceed assets.

Bankruptcy: depending on when it occurred and whether the debt was included.
